1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

2. Description of service

EV Lighthouse provides an online software tool that allows users to track, analyze, and manage their online poker results and related data (“Poker Data”). The Service is provided on a subscription basis and may include free and paid tiers.

We do not provide gambling services, poker games, betting opportunities, or financial advice.

3. Account registration

To use the Service, you must create an account and provide accurate and complete information, including:

  • Email address
  • Password
  • Optional Poker Data you upload or input

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account

We may suspend or terminate accounts that violate these Terms.

4. Subscription plans & billing

EV Lighthouse offers:

  • A free tier with limited features
  • A monthly paid subscription
  • Additional plans (such as annual billing) may be introduced later

By subscribing to a paid plan, you authorize us and our payment processor (e.g., Stripe) to charge your payment method on a recurring basis until you cancel.

No Refunds — All payments are final and non-refundable, including partial billing periods, unless required by applicable law.

5. Cancellation

You may cancel your subscription at any time through your account settings. Your access to paid features will continue until the end of the current billing cycle.

We do not offer prorated refunds.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload harmful, malicious, or infringing content
  • Attempt to reverse engineer, copy, or resell the Service
  • Interfere with or disrupt the Service
  • Share your account with others

We reserve the right to suspend or terminate accounts that violate these rules.

7. User content & poker data

You retain ownership of all Poker Data and other content you upload (“User Content”). By using the Service, you grant EV Lighthouse a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service.

We do not claim ownership of your Poker Data. You are responsible for ensuring you have the right to upload any data you submit.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, how we store and protect it, and your rights under Hong Kong PDPO and applicable international laws (e.g., GDPR).

By using the Service, you consent to the processing of your data as described in the Privacy Policy.

9. Intellectual property

All intellectual property related to the Service — including software, design, branding, and content — is owned by EV Lighthouse Limited.

You may not copy, modify, distribute, or create derivative works based on the Service.

10. Service availability & changes

We may modify, update, or discontinue the Service (or any part of it) at any time. We will make reasonable efforts to notify users of significant changes.

We are not liable for downtime, data loss, feature changes, or service interruptions.

11. Third-party services

The Service may integrate with third-party tools (e.g., Stripe, analytics providers). We are not responsible for the actions, policies, or failures of third-party services.

12. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee:

  • Accuracy of analytics
  • Improvement in poker performance
  • Error-free or uninterrupted service

You use the Service at your own risk.

13. Limitation of liability

To the maximum extent permitted by law:

  • EV Lighthouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; in such cases, the limitation applies to the fullest extent permitted.

14. Indemnification

You agree to indemnify and hold EV Lighthouse harmless from any claims, damages, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your User Content.

15. Termination

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • We suspect fraudulent or harmful activity
  • We discontinue the Service

Upon termination, your right to use the Service ends immediately.

16. Governing law

These Terms are governed by the laws of Hong Kong SAR. Any disputes shall be resolved exclusively in the courts of Hong Kong.

17. Changes to these terms

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
